These Terms of Service ("Terms") govern your use of the Grail Den website at grailden.com and the Grail Den macOS application (collectively, the "Service"), operated by Tier 4 Support Inc. ("we," "our," or "us"). By accessing or using the Service, you agree to be bound by these Terms.

1. Service Description

Grail Den is a platform for entertainment memorabilia collectors. The Service provides tools to search international eBay marketplaces, track collections, and research market pricing. The Service includes both a web application and a native macOS application.

2. Account Registration

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate and complete information during registration.
  • Maintain the security of your account credentials.
  • Notify us immediately of any unauthorized access to your account.
  • Accept responsibility for all activity that occurs under your account.

3. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws.
  • Attempt to gain unauthorized access to any part of the Service or its systems.
  • Use automated tools, bots, or scrapers to access the Service beyond its intended functionality.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Reverse engineer, decompile, or disassemble any part of the Service.
  • Resell, redistribute, or sublicense access to the Service.
  • Violate eBay's terms of service through your use of Grail Den's search features.

4. eBay Integration

The Service integrates with eBay's API. Your use of eBay-related features is subject to eBay's terms of service and API license agreement. We are not affiliated with, endorsed by, or sponsored by eBay Inc. eBay search results and listing data are provided by eBay and are subject to eBay's own terms.

5. Intellectual Property

The Service, including its design, code, features, and content (excluding user-submitted data and third-party content), is the intellectual property of Tier 4 Support Inc. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.

You retain ownership of all data you submit to the Service, including collection records, notes, and uploaded content.

6. Fees and Payments

The Service offers both free and paid tiers. Pricing for paid features will be announced separately. We reserve the right to modify pricing with 30 days' advance notice. Continued use of paid features after a price change constitutes acceptance of the new pricing.

7. Affiliate Links and Commissions

Free-tier users may encounter eBay links that contain affiliate tracking parameters. Grail Den may earn commissions from purchases made through these links. Pro-tier users receive clean, untracked links. The presence or absence of affiliate parameters does not affect search results or listing order.

8. Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure.

To the maximum extent permitted by law, Tier 4 Support Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.

Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless Tier 4 Support Inc. and its officers, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

10. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. You may delete your account at any time by contacting [email protected]. Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law.

11. Modifications to the Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a new "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Los Angeles County, California.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
