1. Acceptance of Terms

By accessing or using Grail Den ("the Service"), operated by Tier 4 Support, Inc. ("Company"), you agree to these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Grail Den is a collectibles intelligence platform that provides expert-led authentication assessments, marketplace search, collection management, and related tools for entertainment memorabilia collectors.

3. Authentication Disclaimer

CRITICAL DISCLAIMER: Authentication assessments provided by Grail Den are professional opinions provided for informational purposes only. They are not guarantees, certifications, or warranties of authenticity. Grail Den is not a professional authentication service. Verdicts should be considered one data point among many when evaluating the authenticity of collectibles. For high-value items, always seek professional, in-person authentication from qualified experts.

8. User Content

You retain ownership of images, descriptions, certificate numbers, signer attributions, authentication evidence, and other content you upload. By uploading or submitting content, you grant Tier 4 Support, Inc. and its affiliates (Grail Den, Screen Grade) a perpetual, irrevocable, non-exclusive, royalty-free, worldwide, fully-paid, sublicensable, and transferable license to use, host, copy, store, transmit, modify, create derivative works of, publicly display, publicly perform, and distribute such content for any lawful purpose, including but not limited to: providing and improving the Service; training authentication models; case studies, press features, and academic research; promotional materials, marketing campaigns, and editorial coverage. You waive any moral rights to the extent permitted by applicable law. This license survives termination of your account and these Terms. You represent that you have the right to upload any content you submit.

Grail Den's signer index, comparable-sale records, marketplace listings cache, exemplar corpus, certificate index, vault price aggregates, and Through-The-Mail database are proprietary, copyrighted, and trade-secret materials of Tier 4 Support, Inc. You expressly agree NOT to:

Violation will result in immediate account termination, IP and ASN-level network blocks, and may be referred for civil action under the Computer Fraud and Abuse Act (CFAA), the Digital Millennium Copyright Act (DMCA), the California Comprehensive Computer Data Access and Fraud Act, and applicable trade-secret statutes. We reserve the right to seek damages, injunctive relief, and attorneys' fees.

The Grail Den platform, branding, models, and original content are owned by Tier 4 Support, Inc. Third-party content (movie titles, show names, character likenesses) remains the property of their respective owners. Authentication assessments generated for your account are licensed to you for personal use only.

THE SERVICE AND ALL AUTHENTICATION ASSESSMENTS ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF AUTHENTICATION RESULTS. WE MAKE NO WARRANTIES ABOUT THE AVAILABILITY OR UNINTERRUPTED OPERATION OF THE SERVICE.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TIER 4 SUPPORT, INC. SHALL NOT BE LIABLE FOR:

Our total liability shall not exceed the amount you paid for the Service in the preceding 12 months.

14. Indemnification

You agree to indemnify Tier 4 Support, Inc. from claims arising from your use of the Service, including misuse of authentication results, violations of these terms, or infringement of third-party rights.

15. Termination

You may delete your account at any time. We may suspend or terminate accounts for violations. Upon termination, your collection data and authentication history may be deleted after 30 days.

16. Governing Law and Arbitration

These terms are governed by the laws of the State of California, excluding its conflict-of-law principles.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service (including its formation, performance, or breach) shall be resolved exclusively through binding arbitration administered by JAMS in Los Angeles, California, before a single arbitrator, in accordance with the JAMS Streamlined Arbitration Rules and Procedures (or, for claims exceeding $250,000, the JAMS Comprehensive Arbitration Rules and Procedures). Judgment on the award may be entered in any court of competent jurisdiction. The Federal Arbitration Act governs the interpretation and enforcement of this provision.

NEITHER PARTY MAY BRING CLASS, COLLECTIVE, OR REPRESENTATIVE ACTIONS in arbitration or in court — all disputes must proceed individually. You may opt out of this arbitration agreement by notifying [email protected] within 30 days of first using the Service; opt-out does not affect any other terms.

Notwithstanding the foregoing, either party may seek injunctive or equitable relief in the state and federal courts of Los Angeles County, California to protect intellectual property rights or confidential information.

17. Changes to Terms

We may update these terms and will notify users via email or in-app notification. Continued use constitutes acceptance.
